Mediation
does not require knowledge of legal theories or preparation of
briefs, motions or other strategy.
Mediation requires a willingness to listen and some
creativity to structure what is needed to resolve the dispute. The process is self-directed. The
mediator guides the parties to focus
on the dispute and its ultimate resolution.
You
can best assist by being
thoroughly prepared; this includes bringing all documents you feel
are important to the dispute to the sessions.
Additionally, the mediator may request the parties fill out
forms prior to meeting and request that parties bring
specific documents to a session.
This is necessary to insure what occurs in your mediation will be the best use of
everyone’s time.
